When someone gets a DUI, I understand that if convicted, this will be a life changing experience. If convicted, your world will change for the worst. You will be faced with the immediate fines, loss of driver’s license and possible jail. After that, you will have a criminal record that cannot be expunged. You will then be forced to pay extremely high priced insurance costs in order to get your driver’s license back.
Law enforcement agencies these days get federal grant money for ARREST of a DUI victim. I have found through my vast experience, that often the cop had no reason to pull the victim over, and did so when they were simply driving late at night or leaving a nightclub. Without probable cause to apprehend the victim, the victim is charged with DUI. That way, the police get their grant money and the victim’s future is placed in jeopardy. In these cases, the lack of probable cause is frequently used by me to secure an acquittal.
Also, many times the cop does not give the victim the required breath test or fails to give the required, PROPER, LEGALLY REQUIRED warning about taking the breath test. Or, the cop does not properly fill out the REQUIRED paperwork. Sometimes the victim does not take the breath test, which by law, he or she does NOT have to take.
Also, I have represented many clients with commercial drivers licenses (CDL’s). I understand how important a CDL client’s driving privileges are because you cannot hold a driving job if convicted of DUI as a CDL driver license holder. I have discovered a legal method I employ that can be successful in getting these cases thrown out or made so they do not affect your CDL driving privileges.
I undertake representation of my DUI clients in a unique manner that is not used by any other lawyer I am aware of. I do not, like many lawyers, take your money and promise an acquittal. I promise you that I will use my experience in this field of law to represent you to the fullest extent of my capabilities.
Unfortunately, not every DUI case can be won, and I know this fact. What I do is take a case for a minimal, reasonable fee, and perform discovery of the DUI and then report back to my client with my HONEST assessment of the case. I will leave no stone unturned. If the case is one where there is no chance of winning, I will so inform my client, and at that juncture, we will appear in Court and try to get any relief on the DUI and other charges that are possible. This allows the client to spend his or her hard earned dollars on fines instead of lawyers.
If I determine that the case is one that can be won, I then am paid to appear in Court. I encourage my clients to participate in this decision should they choose to look at the discovery to make this decision. For instance, the cops may have video and/or audio of the arrest, and if the client wants to come look and/or listen to this with me, then I encourage them to do so. We may then choose to have a trial in the lower Court level and/or on appeal.
With the cases that I take after investigation, the last time I checked, I had a 95% success rate. I am unaware of any other lawyer that can claim this rate of outcome.
