Our client had a permanent DUI license suspension because of 5 DUI convictions. He had been clean and sober for over 10 years and was in line for a promotion that required a valid drivers license. He came to our firm for help. We analyzed 3 of his DUI convictions and determined that two of the DUI convictions from 1994 were legally defective due to specific errors that occurred during the proceedings. We filed motions for post conviction relief based on our findings. The State argued that too much time had passed to allow for the granting of the motions but the court agreed with our analysis and granted the motions. The State did not appeal. The cases were set on the court's docket to be set for trial. Following our successful challenges to some of the evidence the State resolved both cases for reckless driving. Our client is now eligible for a valid drivers license and career advancement
