DUI Case Results in No Conviction.

Client was driving on a busy 4 lane road in Jacksonville at night. She changed lanes into the left turn lane only to realize she needed to turn at the next intersection. She moved back into the thru lane without checking the blind spot. Unfortunately for her a police officer was now traveling in the thru lane she moved back into. She was pulled over for the infraction of improper lane change. To add to her misfortune the officer was a DUI enforcement specialist who detained her due to an odor of alcohol and other physical observations commonly referred to in DUI cases. She began participating in the sobriety exercises but questioned the officer about his instructions. After some discussion she requested to speak with a lawyer and was thereafter arrested for DUI. She agreed to the breath test and blew almost 2x the legal limit. She initially hired a law firm that did not file any motions and recommended she plead guilty. She was referred to Stone, Taylor & Associates and Mitch Stone took the case. Upon reviewing the evidence he filed several motions attacking the evidence against her. These motions resulted in the suppression of some evidence which caused the state to dismiss the DUI and agree to a resolution of a withhold of adjudication and costs on a non alcohol related traffic offense.
