DMV DEFENSE
When you are arrested for DUI, the police will take your license on the spot and issue a Temporary license which is only good for 30 Days. The DMV will suspend your license after the 30 days if you let them. You have only 10 calendar days from the date of arrest to call the DMV (916-227-2970) to request a hearing and to challenge the Suspension.

Everyone should make that call because DMV cannot suspend your license unless three things are shown at the Hearing: (1) PROBABLE CAUSE (to stop your vehicle); (2) A VALID ARREST; and, (3) DRIVING WITH A BLOOD ALCOHOL LEVEL IN EXCESS OF .08.

Your defense to the Suspension will protect your Right to Drive, if any of the three are not supported by evidence at the Hearing. If you don't call for a hearing, the DMV will ASSUME the evidence is sufficient.

Typically, if you are convicted of a First Offense, it's a Misdemeanor, and you must do two days in jail, pay fines of about $2000, serve 3 years informal Probation and attend DUI Classes for 3 months. You may also be required to have an Ignition Interlock Device installed on your car for a "high blood alcohol level" (currently .15 in most courts) or serve more jail time or both if an accident was involved.

The officer must correctly administer both the Field Sobriety Tests and either the Breath or Blood Tests.
